Mother’s Day is a time to celebrate strength, care, and resilience, and honor the countless ways parents nurture their children. Yet for millions of mothers with disabilities in the United States, this celebration highlights a harsh reality: the systems meant to support families often fail them.

Disabled mothers face structural challenges across healthcare, employment, and economic systems. They often encounter heightened scrutiny and, in some cases, risk losing custody of their children.

An estimated 2.5 million mothers have a disability. Research shows their parenting is often unfairly judged under the misconception that they are less capable than non-disabled parents. A 2012 report by the National Council on Disability documented that parents with disabilities face disproportionately high rates of child welfare involvement, often driven by outdated assumptions rather than evidence. As of 2022, 42 states and the District of Columbia include parental disability as a criterion for terminating parental rights, according to The Regulatory Review and data from the National Research Center for Parents with Disabilities. These policies are not rooted in child safety but reflect systemic ableism that penalizes parents with disabilities.

The scrutiny does not end there. Disabled parents are more likely to be reported to Child Protective Services and are more likely to lose custody, even when there is no evidence of harm. This heightened scrutiny can compound stress, undermine parental confidence, and force families into expensive legal battles to remain together.

Healthcare presents another formidable barrier. Women with disabilities who want to become mothers often face inaccessible exam tables and medical equipment, providers untrained in disability care, and systemic biases that discourage pregnancy. The National League for Nursing notes that some providers respond to disabled patients’ interest in pregnancy by discouraging the idea altogether, assuming the patient is seeking termination, or questioning their judgment and responsibility. During pregnancy and postpartum, many women report unmet care needs, inaccessible prenatal education, and feeling dismissed or dehumanizedby medical staff. These failures contribute to disparities in maternal healthcare outcomes, leaving disabled mothers to navigate pregnancy with inadequate support.

Economic challenges add another layer of difficulty. Mothers with disabilities often shoulder higher baseline costs for assistive technology, transportation, and healthcare, while childcare adds a significant financial burden. In 2022, U.S. families spent between 8.9% and 16.0% of their median income on full-day care for one child, with annual costs ranging from $6,552 to $15,600 – comparable to what the average American household spends per year on food. Federal financial rules intensify these pressures. Individuals receiving Supplemental Security Income (SSI) are limited to $2,000 in assets, and couples can see their benefits reduced under the SSI marriage penalty. This “double burden” of disability-related costs plus child-rearing expenses can undermine families’ independence and well-being.

Limited employment opportunities compound these economic challenges. Lower employment rates for disabled adults, lack of paid leave, and inflexible schedules can reduce financial stability and increase reliance on restrictive benefit programs. The U.S. Bureau of Labor Statistics consistently documents that people with disabilities participate in the labor force at rates far below their peers, limiting income and the social and professional opportunities that support family life.

There has been progress. In July 2024, the U.S. Department of Health and Human Services strengthened enforcement of Section 504 of the Rehabilitation Act, explicitly prohibiting discrimination against parents and prospective parents with disabilities in child welfare systems. Yet policy alone is not enough. Implementation remains uneven, with staggered deadlines for accessibility requirements, and ongoing lawsuits – such as the Texas v. Kennedy case (previously Texas v. Becerra) – threatening to undermine these protections.

A better approach is possible when mothers with disabilities are treated with dignity, respect, and meaningful support. Families thrive when systems focus on empowering parents instead of scrutinizing them. This means protecting parental rights so that disability is never used as a reason to separate families; ensuring accessible, high-quality healthcare throughout pregnancy and postpartum; and expanding economic supports. Paid leave and childcare subsidies can reduce financial stress, while programs like Medicaid Buy-In allow parents with disabilities to work without immediately losing their healthcare coverage, providing stability for both parent and child. Healthcare providers, social workers, and child welfare professionals should receive training to work collaboratively with parents, providing guidance, accommodations, and support, and basing decisions on current evidence rather than outdated assumptions.
