UPC's Hamburg Local Division denies preliminary injunction: Ballinno v. Kinexion & UEFA

he Unified Patent Court's Hamburg Local Division has just dismissed a preliminary injunction request by Dutch company Ballinno against Kinexion and UEFA over semi-automated offside detection at the EURO 2024 soccer championship that will start in Germany next week.

At today's hearing, Presiding Judge Sabine Klepsch, Judge-rapporteur Dr. Stefan Schilling and Judge Samuel Granata were unconvinced of infringement, urgency and the fact that the non-practicing entity plaintiff was entitled to a PI. The court will state its reasons in writing. For now, it has just ordered the denial of the PI motion.

Theoretically, Ballinno could appeal this decision to the UPC's Court of Appeal.
