UPC Roundup; UPC+BSH the new winning formula; Netflix countersuit against Broadcom dismissed

1) UPC Roundup (1 week): stay pending appeal granted over defendant’s objection; various cost-related decisions and one about unitary effect


This is a summary of developments in and around the Unified Patent Court (UPC) in the week since our August 3, 2025 UPC Roundup.


2) LinkedIn post: Is UPC+BSH the new winning formula? Is BSH only a UPC thing or do national courts get BSH cases as well?


The UPC has already granted a UK injunction and made various other jurisdictional decisions on BSH cross-border claims (which sometimes didn't come to fruition for lack of liability and in other cases liability is yet to be determined). But if you are also aware of any BSH claims in national courts, please don't hesitate to let us know.


3) Netflix countersuit against Broadcom thrown out as patent claims deemed abstract, amendment allowed but not necessarily helpful


A strict application of § 101 resulted in the dismissal of one of Netflix’s coutnersuits against Broadcom. An amended complaint would be entertained, but won't necessarily help. Parts of this article are accessible only with a premium membership.


4) Opinion: The Trump Administration is not above the law — but neither is Harvard: patent march-in rights


Whatever allegations the Trump Administration makes against Harvard and its affiliates may ultimately have to be discussed in court. But Harvard’s compliance is not beyond doubt.
